The Gujarat State Consumer Disputes Redressal Commission has clarified that individuals receiving free medical treatment are considered consumers under the Consumer Protection Act. This determination stems from the Commission’s view that hospitals provide a “service,” regardless of whether a fee is charged. The ruling implies that hospitals can be held liable for negligence even in cases where no payment was made for treatment.
Citing a prior Supreme Court decision, the Commission has directed the District Forum to re-examine an old case within six months, based on this interpretation. This development originated from an appeal by a family that had previously sought redressal.
