A bench comprising Chief Justice of India B R Gavai and Justice K Vinod Chandran determined that these provisions were largely re-enactments of clauses previously invalidated by the court in an earlier Ordinance, with only minor modifications. The Court concluded that this amounted to "legislative overwriting" without addressing the original defects, thereby infringing upon the fundamental principles of the separation of powers and judicial independence.
