Supreme Court Delivers Interim Orders on Waqf (Amendment) Act 2025

The Supreme Court is scheduled to pronounce its interim orders today concerning several petitions challenging the validity of the Waqf (Amendment) Act, 2025. Petitioners have raised objections to three key provisions within the Act. These include the power to denotify properties previously declared as waqf by various means, questions regarding the composition of state waqf boards and the Central Waqf Council, and a specific provision stating a property may not be treated as waqf if a collector’s inquiry ascertains it as government land.

The Union Ministry of Minority Affairs filed a comprehensive affidavit on April 25, defending the Act and opposing any blanket stay by the court. The Ministry emphasized the presumption of constitutionality for laws passed by Parliament. The Waqf (Amendment) Act, 2025, received presidential assent on April 5 and was subsequently notified by the Centre on April 8, following its passage by both the Lok Sabha and the Rajya Sabha in April of this year.
