Adidas is suing Australian fashion label White Fox over its use of a four-striped design on clothing, which the German sportswear giant claims is too similar to its own iconic logo. Adidas alleges that White Fox has refused requests to stop selling and promoting the items since March.
White Fox, an online retailer popular with young people in Australia, the UK, and the US, has denied breaching Adidas’s trademark. Lawyers for White Fox indicated they intend to argue that other Australian brands also sell clothing with similar decorative stripes.
Adidas claims White Fox’s four-striped designs are “substantially identical with or otherwise deceptively similar” to its own trademarked three-striped design, which has been registered in Australia since 1957. The company also argues that White Fox’s advertising, which sometimes features genuine Adidas items, could mislead consumers into believing the brands are associated.
The sportswear giant is seeking damages, including profits made from the disputed products, plus interest and costs. A trial is anticipated to take place early next year.
