Dr. Angmo, wife of climate activist Sonam Wangchuk, has filed a habeas corpus petition in the Supreme Court of India. The petition challenges her husband’s preventive detention under the National Security Act (NSA), 1980, and seeks his immediate release. This legal action follows violent protests that occurred in Leh on September 24. The NSA, specifically Section 3, empowers the appropriate government to issue detention orders for preventive detention if an individual’s activities are deemed prejudicial to public order, state security, India’s foreign relations, or the maintenance of essential community services. The Act requires that detention orders be based on “vital and relevant material,” be reasoned, and be supplied to the detained person or their family. The Supreme Court has consistently characterized preventive detention as a “drastic measure” that infringes upon an individual’s fundamental right to personal liberty.
