The Court of Appeal has ruled that a legal challenge against the Home Office’s proscription of Palestine Action under the Terrorism Act can proceed. This decision upholds Mr. Justice Chamberlain’s grant of a judicial review, initiated by Huda Ammori, a co-founder of Palestine Action, to contest the group’s categorization alongside designated terrorist organizations.

The Home Office had appealed the decision, contending that the appropriate forum for such a challenge was the Proscribed Organisations Appeal Commission (POAC). However, the High Court was determined to offer a swifter resolution and provide an authoritative determination for individuals accused of related offences since the ban’s implementation on July 5.

This proscription represents the first instance of a direct action group being banned under the Terrorism Act, and since its enactment, over 2,000 arrests have been made for alleged support. The High Court hearing is slated to begin on November 25 and will span three days. This case marks a significant precedent as it is the first time an organization banned under anti-terrorism law has been granted a court trial to challenge its proscription.
