The International Court of Justice (ICJ) is slated to deliver an advisory opinion concerning Israel's legal obligations toward United Nations agencies and other international organizations operating within the occupied West Bank and Gaza Strip.
This request originated from the UN General Assembly, following the implementation of Israeli legislation that prohibited activities by the UN agency for Palestinian refugees (UNRWA) on Israeli territory and restricted contact with Israeli officials. Israel has previously asserted that UNRWA was infiltrated by Hamas and accused Hamas of diverting aid.
The ICJ's review will focus on two key aspects: first, whether Israel's ban on UNRWA contravenes UN conventions upholding the independence of UN agencies; and second, whether Israel's restrictions on aid access into Gaza violate international humanitarian law, particularly its responsibilities as an occupying power to safeguard civilians.
During the proceedings, legal counsel representing the Palestinian government characterized Israel's actions, including alleged infringements on Palestinian fundamental rights and obstructions of UN operations, as "unprecedented." Conversely, Israel has publicly dismissed the ICJ's procedure as a "political circus" and an "abuse of international law and institutions."
