The Delhi High Court has issued a notice to the Central government regarding a petition filed by Christian Michel, an accused in the AgustaWestland VVIP helicopter case. Michel's petition challenges the supremacy of the India-UAE extradition treaty over the Indian Extradition Act, 1962, contending that a bilateral treaty cannot supersede a statute enacted by the Indian Parliament. Additionally, the petition alleges that the introduction of new charges, including those under Section 467 of the IPC, violates the Doctrine of Speciality and conflicts with the original extradition decree from UAE authorities. He further claims unlawful detention, asserting that he has already completed the maximum imprisonment term for the offences initially listed in the charge sheet and extradition decree. The petition also argues that charge sheets from the CBI and ED lack material evidence for allegations of cheating, money laundering, or financial impropriety, and that these supplementary charges lack authorization from the extradition decree, rendering them unsustainable under Indian jurisdiction.
