State Cites Prior Dismissal in Yediyurappa POCSO Case Challenge

Proceedings are underway in the Karnataka High Court regarding a challenge filed by former Chief Minister B.S. Yediyurappa against the cognizance of a case under the Protection of Children from Sexual Offences (POCSO) Act.

During a recent hearing, the state counsel informed the court that several arguments presented by Yediyurappa’s legal team had previously been dismissed in an earlier petition before the High Court. The case originates from an accusation made in March 2024 by a woman who alleged that Yediyurappa inappropriately touched her minor daughter when they visited him to seek assistance concerning a prior instance of sexual assault. An FIR was registered by Bengaluru police on March 14, 2024.

This marks Yediyurappa’s second challenge to the cognizance of the case. An earlier successful challenge, adjudicated by Justice M Nagaprasanna, had led to the re-doing of the initial cognizance process, which was deemed to have been conducted “without application of mind.” Justice M I Arun’s bench is scheduled to continue hearing the matter, including Yediyurappa’s response, on October 23.
