Supreme Court Refers Minor Custody Allegation to High Court

The Supreme Court of India on Monday, September 15, 2025, declined to directly examine a plea alleging sexual assault and custodial torture of a 17-year-old boy by the Gujarat Police. A bench comprising Justices Vikram Nath and Sandeep Mehta directed the petitioner to first approach the High Court, questioning why the High Court had not been moved under Article 226 previously.

The petitioner’s counsel had highlighted the alleged brutality against the minor and asserted broader implications concerning the treatment of minors in police custody across India. The plea had sought specific interventions, including a directive for the All India Institute of Medical Sciences (AIIMS), New Delhi, to constitute a medical board to assess the minor’s injuries, or alternatively, a court-monitored investigation by the Central Bureau of Investigation (CBI).

The Supreme Court clarified that the High Court was capable of addressing such prayers and stated, “You go to the high court and if the high court does not deal with your matter, you come back.” Upon agreeing to approach the High Court, the counsel requested the Supreme Court to consider an order for the preservation of CCTV footage from the Botad town police station.
