This determination stems from the Commission’s view that hospitals provide a “service,” regardless of whether a fee is charged. The ruling implies that hospitals can be held liable for negligence even in cases where no payment was made for treatment.

Citing a prior Supreme Court decision, the Commission has directed the District Forum to re-examine an old case within six months, based on this interpretation. This development originated from an appeal by a family that had previously sought redressal.
